Welcome to FitGenie ("Company", "we", "us", "our"). These Terms and Conditions ("Terms") govern your access to and use of the FitGenie Website, WhatsApp Bot, Telegram Bot, AI-powered coaching platform, and all related applications, digital content, and services ("Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please discontinue using FitGenie immediately.
These Terms constitute a legally binding agreement between you and FitGenie. By accessing any part of the Services—including via WhatsApp or any automated AI interface—you agree to comply with these Terms. Continued use of the Services will be considered acceptance of updated versions of these Terms.
FitGenie provides fitness, nutrition, and lifestyle guidance through AI and human advisors (where applicable). All information is intended solely for educational and informational purposes.
FitGenie DOES NOT:
No doctor–patient relationship is established through use of FitGenie.
Users with medical conditions—including but not limited to heart disorders, diabetes, thyroid conditions, hypertension, PCOS/PCOD, pregnancy, joint injuries, or chronic illnesses—must consult a licensed healthcare provider before following any FitGenie advice.
FitGenie uses advanced AI technology to generate personalized diet plans, workout plans, reminders, habit suggestions, and lifestyle guidance. By using FitGenie, you acknowledge that:
AI responses may be incomplete, outdated, or incorrect.
FitGenie, its developers, affiliates, or partners are not liable for misinterpretation of AI-generated messages, inaccurate diet or workout plans, health consequences related to AI suggestions, or physical/psychological harm resulting from actions taken based on AI output.
You are solely responsible for verifying advice with a medical professional.
AI interactions do NOT create a physician–patient or therapist–client relationship.
FitGenie operates on WhatsApp and other third-party messaging platforms. By using these:
Messages pass through WhatsApp/Telegram servers. FitGenie has no control over message delivery failures, outages, encryption, delays, or message retention by WhatsApp.
FitGenie is not responsible for other individuals accessing your device, loss/theft of your phone, forwarded chats/screenshots, or data breaches occurring on WhatsApp or user devices.
If you submit images, lab reports, medical information, or sensitive data via WhatsApp, you voluntarily provide this data. FitGenie may store and use it for personalization. You understand WhatsApp is not a HIPAA-compliant or medical-grade secure platform.
AI or human responses may be delayed or unavailable due to WhatsApp outages, server maintenance, internet issues, or AI model downtime.
By participating in workout plans, diet plans, or fitness activities recommended by FitGenie, you voluntarily assume full responsibility for all associated risks.
You acknowledge that fitness activities carry a risk of injury, illness, or death, dietary changes may impact your health, and you voluntarily engage in activities at your own risk.
You hereby release and hold harmless FitGenie, its AI systems, coaches, employees, contractors, and affiliates from ANY liability related to injuries, health deterioration, allergic reactions, exercise-induced complications, nutritional side effects, or worsening of existing health conditions.
By using FitGenie, you agree to provide truthful health information, inform FitGenie of medical conditions, not misuse or abuse the platform, avoid using the AI for harmful or illegal purposes, and use good judgment when following advice.
FitGenie may suspend or terminate users for false reporting, harassment, or Terms violations.
FitGenie may offer paid subscription-based services. Payments must be accurate, complete, and updated. All purchases follow FitGenie's pricing and refund policy: Subscriptions may be non-refundable, refunds (if eligible) are processed to the original payment method, and charges may change without prior notice.
FitGenie collects information such as lifestyle questionnaire data, chat logs, workout/nutrition logs, and uploaded documents or images. This data is securely stored in compliance with platform standards.
Anonymized user data may be used to improve AI performance. FitGenie does not sell personal data to third parties.
All content, branding, text, software, workouts, diet frameworks, AI-generated content, and digital assets belong to FitGenie and are protected by copyright and trademark law. Users may not copy, distribute, sell, reverse engineer, or create derivative works without written permission.
FitGenie reserves the right to modify or discontinue features, change pricing, update AI models, and change Terms at any time. Continued use after modifications constitutes acceptance.
We may suspend or terminate access for policy violations, abuse or harassment, false information, misuse of platform, or legal requirements.
FitGenie shall not be liable for injuries resulting from workouts, health issues from diet plans, AI inaccuracies, loss of data, WhatsApp privacy breaches, service interruptions, user negligence, or emotional/psychological effects of advice. Your use of FitGenie is entirely at your own risk.
These Terms are governed by the laws of India. Jurisdiction: Pune, Maharashtra.
